Yes, under a clause stating, “90 days’ notice, of which 60 is mandatory and the remaining 30 can be adjusted against gross pay,” the employee has a contractual right to serve 60 days and buy out the last 30. Management cannot unilaterally turn this into a discretionary privilege unless the contract or a binding policy explicitly says so.
