If worker's week drops to 40 hrs due to leave/permission, can the employer extend other days to 48 hrs/week without OT under Factories Act?

No. Under the Factories Act, 1948, the daily limit of 9 hrs/day applies. So, even if the weekly cap is 48 hrs, in this case the worker can only reach 44 hrs/week without overtime. Any work beyond that attracts overtime pay.
