ABOUT PREVENTION OF SEXUAL HARASSMENT AT WORKPLACE (POSH)
Even though the concept of sexual harassment is as old as the history of mankind, its implication at the work place has received attention in recent times. In fact until the verdict in Vishaka Vs. State of Rajasthan (1997) case by the Supreme Court of India in 1997, there were no official guidelines to deal with the subject. Thereafter the central government has enacted Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013, under which the employer is duty bound to protect the women at workplace. This Act aims to protect women against sexual harassment at workplace by preventive measures like training, prohibitive measures like legal restriction, punitive measures like disciplinary action by employer or criminal action by police and rehabilitative measures like transfer and monetary compensation. Hence there is a need for managers and executives to learn the legal aspects, case laws and detailed procedure to protect the women at workplace.
APPLICABILITY
The Act came into force with effect from 9th December 2013. This Act is applicable to all the workplaces including dwelling house. All the women at workplace irrespective of their age, salary, designation and nature of employment, are protected under this Act. Even non-employed women like consultants, service providers, customers and suppliers are protected by this Act. The perpetrators of harassment can be male or female employees or non employees like consultants, service providers, customers or suppliers.
METHODOLOGY
Participants of this workshop will learn through, lectures, role plays, assignments, and practice sessions to gain hands on experience in creating harassment free at workplace and for implementing POSH Act.

LEARNING OBJECTIVES
After attending this course, the participants will be able to understand and take measures on
- What are the preventive measures to be taken by employer to create a harassment free workplace.
- How to determine if a case comes under POSH Act, domestic enquiry or police case.
- What are the employers' responsibilities under POSH Act.
- How to form a complaints committee, conduct the enquiry and find out the truth under POSH Act.
- The composition of the committee, its powers and duties, and qualification of the members and the chair person.
- How the employer should protect and support the victim of harassment.
- What actions can the employer take against the harasser?
- Notices to be displayed, registers to be maintained and returns to be submitted under the Act.
FEES
- Rs.8000 + 18% GST per participant.
- Early bird offer: Rs.7000+18% GST per participant if fees along with registration form are received by us on or before 10th January 2024.
- Group rate: Rs.7000+18% GST per participant if three or more participants are nominated from the same organization.

RESOURCE PERSONS
Dr. G.P. Naik is professor of HRM and Labour Legislation and an experienced trainer in HR domain. He is a doctorate in Management from Canara Bank School of Management Studies, Bangalore University. Previously he was the Head of Learning and Development at Karle Group of Companies, Bangalore. He is a graduate in Law and has handled more than 100 employee discipline cases in his previous organizations. He has provided training and consultancy services to several reputed organizations like Karnataka Employers' Association, International Labour Organization, Labour Department of Government of Karnataka, Indo-Nissin, Sasken, Persistent Systems, Sasaara Financial Services, Aditya Birla, Oracle, Infosys, MTR Foods, Schneider, Chamundeshwari Sugars, Ultratech Cements, Madura Coats, BEML, BEL, Exedy, IndoMIM, TRMN, Biesse, Homag, Faiveley, Fowler Westrup, Hampson Aerospace, TCE, ASE, NTPC, HAL, TVS Motors, GMR, Toyota Kirloskar, Autolive, Schmetz and Eigen.
Mrs. Sangeetha M.S. is an Advocate practicing mainly in Labour Courts, Industrial Tribunals, NCLT and High Court of Karnataka at Bengaluru. She has been associated with M/s CCI – Legal one of the leading law firms specialized in Industrial & Labour Laws for the past 6 years.
She is a graduate of Law from Bangalore Institute of Legal Studies, Bengaluru affiliated to Karnataka State Law University and post graduate diploma in Personnel Management & IR.
Adv. Sangeetha has handled various cases relating to industrial disputes ranging from dismissal, retrenchment, discharge, Charter of Demands, Change in Service Conditions under Section 9 – A of the ID Act, Payment of Gratuity, Payment of Bonus, disputes pertaining to regularization of Contract Labour, violation of Contract Labour License etc. to name a few.
Apart from the aforesaid litigations, she has also conducted several departmental enquires as Enquiry Officer and most of the enquiries held by her have been upheld by respective labour courts. Currently, she is an Executive Committee Member of Greater Bengaluru Employers Association, an association formed under the Trade Unions’ Act, 1926 for the purpose of protecting & promoting the interest of Employers through advocacy, representation & research.
Being an office bearer of Greater Bengaluru Employers Association, she assists various corporates as an External Member of their Internal Committee (IC) constituted under the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act, 2013. As an external member she has drafted POSH policy & procedures for various corporates, trained members of the Internal Committee for various corporates besides conducting POSH awareness sessions to employees. She has also guided chairpersons of the Committees’ in conducting enquiries as and when required. To her credit, she has been called by various employers/corporates to address women employees on the occasion of Women’s Day celebrations.
Currently, she is associated with following corporates as External Member of their Internal Committee.
